We invite you to read the following terms and conditions that govern the provision of Services and the use of the Site.

Acceptance of these terms is done through the so-called “point and click”, simply by filling out the electronic form and clicking on the acceptance button or icon. Therefore, by using the Site and the services contained therein, Users agree to comply and be legally bound by the terms of service.

This document represents the Terms and Conditions of use of the website www.retrokit.it.

retrokit.it reserves the right to modify, update, and remove the full version of the Terms and Conditions at any time, with or without notice, by updating the date at the top of the document.

If the User does not agree with any part of these Terms and Conditions, please do not browse our website.

The term www.retrokit.it or Retrokit or "we," "Site," "Ours," refers to the site used by the company MOTOVELOCI SRL (VAT number 04595090400), headquartered in Rimini, Via Portogallo n°20, represented by the legal representative Alex Leardini (Tax code LRDLXA89C18H294R).

The use of this website is subject to the following conditions.

TERMS AND CONDITIONS OF USE

  • Any access or use of the Site, Application, or Services by anyone under the age of 18 is expressly prohibited. By accessing or using the Services, the User declares and guarantees their legal age.
  • Users undertake to use the services offered according to the conditions and methods provided by the Site.
  • The responsibilities of retrokit.it are exclusively related to the use of the Site, Application, and Services.
  • Users, through the completion of the appropriate form and acceptance of the same, including the onerous clauses and the payment of the non-interest-bearing deposit, will adhere to the proposal for a preliminary sales contract subject to a suspensive condition contained therein. Pursuant to art. 1353 of the Italian Civil Code, the effectiveness of the preliminary contract and, therefore, the commitment to the stipulation of the definitive sales contract, is subject to the fulfillment of both of the following conditions: a) promulgation, application, and effectiveness of the National Regulations relating to the procedures for national approval, for the purpose of homologation, and the procedures for the installation of electric requalification systems on vehicles of international categories L, originally registered with a thermal engine; b) homologation of the KIT, the subject of this contract, by the Ministry of Transport.
  • retrokit.it disclaims any responsibility for any damages to things or persons, including damages for loss or missed profit, loss of stored information, or resulting economic losses, directly or indirectly, from the non-fulfillment of the suspensive clause referred to in art. 4 of the aforementioned contract. No compensation will be due to the User/Promissory Buyer in any case, given the nature of this agreement: preliminary sales contract with a suspensive condition. 
  • Each User acknowledges and accepts to assume the exclusive responsibility for any activity or action related to their access to retrokit.it.
  • retrokit.it, the owner, the managing company, and their respective legal representatives cannot in any way be held responsible for the information communicated by Users, which may be inaccurate, erroneous, illegal, or fraudulent.
  • Users agree to use the Service exclusively for informational and/or acceptance purposes of the proposal for a preliminary sales contract subject to a resolutive condition. 

INTELLECTUAL PROPERTY

The appearance, trade name, and content of the Site are protected by Italian and International laws on Copyright and against acts of unfair competition. Retrokit.it holds all rights related to the content therein, whether owned or licensed to retrokit.it. 

All rights are reserved regarding any registered or unregistered trademarks appearing on the Site (whether owned or licensed to retrokit.it, Alex Leardini, or Motoveloci S.r.l.).

Any reproduction, duplication, copying, sale, resale, or any other exploitation for commercial purposes is prohibited without the express consent of motoveloci.it. It is also prohibited to extract the content or use parts of the site's content without the written consent of motoveloci.it. In particular, the use of data mining, robots, data gathering techniques, or data extraction systems for any reuse is strictly prohibited.

PRIVACY

The User declares to be informed and gives consent to the processing of their data in accordance with Legislative Decree no. 196/2003 (Privacy Code), European Regulation no. 679/2016 (GDPR), and the relevant ministerial decrees. 

DISPUTE RESOLUTION

In case of a dispute with retrokit.it for the service offered, referred to in art. 1, the parties (MOTOVELOCI S.r.l. and the User) agree to refer the resolution related to the interpretation and application of the Terms and Conditions of motoveloci.it to an attempt at conciliation under Legislative Decree no. 28 of 2010 and subsequent amendments based on the Mediation Regulation of ADR Center, registered at no.1 in the Register of bodies authorized to manage conciliation attempts of the Ministry of Justice. The regulation, forms, and the table of allowances in force at the time of activation of the procedure can be consulted at www.adrcenter.it. If the conciliation attempt fails, the dispute will be referred to the judicial authority provided for in the subsequent art. 9 of the complete contract.

REFERENCES TO OTHER NAMES AND TRADEMARKS

Motoveloci SRL is an engineering company specializing in the design, prototyping, and production of systems for the electric conversion of classic scooters. Motoveloci SRL and the Retrokit brand are not sponsored, associated, approved, nor in any way affiliated with the Vespa or Piaggio & Co SPA brand. 

The name and emblem Vespa are registered trademarks of Piaggio & Co SPA, and any other product or brand is owned by their respective owners.

Any mention of trademarks and logos is to be understood only as a reference and indication.
